When families choose to place their loved one in the care of a nursing home, there is an expectation that the individual will receive excellent care, nutrition, and support.  No family wants to consider that rape in nursing homes is a problem, or even a consideration.  Unfortunately, recent headlines suggest that families do, in fact, need to be aware of the risk of rape or assault in nursing homes.

Unsettling Headlines for Texas Nursing Home

In May 2015, a man working at a Texas nursing home was arrested after he was discovered in bed with a 76-year-old nursing home resident.  The employee reportedly had his pants down when another staff member entered the resident’s room.  Police were called and the man was taken into custody.  The 27-year-old admitted and detailed his actions, and was charged with aggravated sexual assault of an elderly or disabled person.  The nursing home and the employee are now under investigation to determine if any other residents have been sexually assaulted.

The victim in this case reportedly has “limited mental function”, which may have impacted her ability to respond to the situation and get appropriate help.  This arrest highlights the importance of families and nursing home staff to be cautious and understand the signs, symptoms, and unspoken warning signs of sexual assault.  It is most important to recognize the risks and warning signs in residents who are most vulnerable, such as those who have limited mobility, are mentally disabled, or who have difficulty speaking or expressing themselves.

Research Highlights Prevalence of Rape in Nursing Homes and Offender Data

Researchers, lawmakers, and advocates for the elderly continue to address the issue of rape in nursing homes, including better measures for identifying sexual assault incidents and their frequency.  Research funded by the U.S. Department of Justice indicates that sexual offenses against elderly individuals in nursing homes are a significant concern.  One of the primary reasons for concern is the fact that so many crimes against elderly individuals go unreported.

Research conducted in 1996 indicated that as many as 84 percent of elder abuse cases go unreported to Adult Protective Services (APS).  Continuing research indicates that there are several reasons why elderly sexual abuse is underreported, including:

  • Elderly individuals are less likely to pursue psychological services following sexual abuse
  • Elderly individuals often feel a great deal of shame and are uncomfortable speaking openly about sexual abuse
  • Healthcare providers and caregivers often fail to recognize sexual abuse among elderly individuals
  • Because elderly individuals often complain of aches, pains, and bruising, it is difficult to diagnose complaints as sexual abuse rather than a common malady of aging

Signs and Symptoms of Rape in Nursing Homes

While elderly individuals may be reluctant to speak openly about sexual assault, there are some telltale signs and symptoms of which families, healthcare providers, and caregivers should be mindful.  Such signs and symptoms include:

  • Unexplained bruising around the neck, chest, or genitals
  • Bloody or stained undergarments or bedding
  • Unexplained bleeding of the genitals or anal area
  • Infections to the genital area or diagnosis of an STD
  • Withdrawing from social activities
  • Sudden change in mood, such as anxiety or depression
  • Anxiety or fearful behavior when certain staff members are present

Anytime there is speculation of sexual assault or rape in a nursing home, it should be reported to local authorities for investigation.  Rape in nursing homes is a serious and heart wrenching problem, and should not be tolerated or excused.
