Medical malpractice lawyers in Dallas, and elsewhere across Texas, may not be surprised to learn that a Fort Worth family recently filed a medical malpractice claim against a local hospital.  According to  reports, a 32-year-old wife and mother suffered a seizure and was transported to the hospital via ambulance.  At the emergency room, a CT scan was taken, which indicated that there was blood on the patient’s brain.  Emergency room doctors diagnosed the woman with stress-related migraines and a sinus infection, prescribed medication, and discharged her home.  Several hours later, the woman suffered another seizure and was transported via ambulance to a different hospital.  During the ambulance ride she suffered a third seizure.

Upon arrival at the second hospital, the woman’s husband was told that she was “brain dead”.  She was removed from life support the following day and was declared deceased.  The woman left behind her husband and two young children.  Her husband is working with an attorney and has filed a medical malpractice claim in Dallas County citing conscious indifference.  It is believed that proving negligence will not be difficult, as the CT scan clearly indicated bleeding in the brain, though no treatment was provided, nor additional tests conducted.  The family believes that she should never have been discharged from the first hospital, and would still be alive had the hospital conducted further testing and offered appropriate treatment.  There is also a question of whether the emergency room doctors reviewed the CT scan results.  The hospital and staff have declined to comment on the case.
